Wszyscy chyba przyzwyczailiśmy się już, że wielkie wytwórnie fonograficzne zaciągają użytkowników dzielących się plikami oraz strony slużące bezprawnemu rozpowszechnianiu plików objętych copyrightami do sądu. Nikt się chyba jednak nie spodziewał, że artyści wniosą pozew o dokładnie to samo przestępstwo przeciwko wytwórniom nagraniowym. Tak jednak się stało: Warner, Sony BMG, EMI i Universal muszą stawić czoła zarzutom wycenionym na 60 miliardów dolarów za szkody spowodowane masowym „spiraceniem” 300,000 ścieżek dźwiękowych.
Jak się coraz częściej ostatnio okazuje, wytwórnie nagraniowe mają, delikatnie mówiąc, podwójne standardy, jeżeli chodzi o rozumienie prawa autorskiego. Z jednej strony próbują wsadzić operatorów stron BitTorrent do więzienia i rujnować życie matek oraz studentów żądając setek tysięcy dolarów opłat za udostępnianie muzyki w sieciach P2P, a z drugiej strony sprzedają CD zawierające muzykę, do której nie mają właściwych praw na rozpowszechnianie.
Wytwórnie mają zwyczaj używania utworów od szerokiej rzeszy artystów w celu stworzenia kompilacji na CD, bez uprzedniego zabezpieczenia odpowiednich praw. Po prostu używają nagrania a następnie zapisują jego nazwę na “liście rzeczy do zrobienia” żeby zająć się nim później. Ponieważ robią tak od lat osiemdziesiątych, lista nieopłaconych ścieżek (lub naruszeń praw autorskich artystów) sięgnęła ogromnej liczby 300,000 ścieżek.
Jako jeden przykład z wielu można wymienić niedawne wydarzenie, kiedy to największy artysta ameryki łacińskiej, Alejandro Fernández wysłał policję do biura Sony Music w celu konfiskaty ponad 6000 płyt CD, których to wytwórnia odmówiła zwrotu.
Zmęczona już „piractwem” wytwórni, grupa artystów w Kanadzie złożyła pozew przeciwko wszystkim czterem wielkim wytwórniom połączonym z CRIA, odpowiednikiem RIAA w USA i ZAIKSu w Polsce. W listopadzie zeszłego roku, Warner Music, Sony BMG Music, EMI Music i Universal Music zostały pozwane za nielegalne użytkowanie tysięcy ścieżek i aktualnie sprawa jest nadal w toku.
Wytwórnie nagraniowe do dnia dzisiejszego już przyznały, że są winne co najmniej 50 milionów dolarów za naruszenie praw autorów, ale ta suma może urosnąć nawet do monstrualnych 60 miliardów dolarów.

Najczęściej skończą się symboliczną grzywną i wyrokiem w zawiasie.
P2M to utopia i nigdy nie będzie mogło działać na taka skalę jak zwykłe P2P. Na P2M najwięcej tracą zwykli użytkownicy poczty, którzy są karani różnymi ograniczeniami captchami i innym syfem, którego wcześniej nie było.

Porownanie tego przypadku do praw autorskich jest o tyle chybione, ze ignoruje kwestie skali. Wytworniom fonograficznym lamanie prawa zdarza sie rzadko, natomiast w przypadku torrentowni lamanie prawa autorskiego jest podstawowym sensem ich istnienia.
E, 300.000 ścieżek (razy ilość sztuk nośników jak rozumiem) to mała skala?
I to nie jest "porównanie z prawami autorskimi" – kwestie rozpowszechniania to są właśnie kwestie prawnoautorskie. To prawo obejmuje zarówno rzeczy związane z autorstwem, dystrybucją, jak i zdobywaniem oraz wykorzystaniem w innych utworach, czyli całokształt wraz z określeniem zastosowania dozwolonego użytku, prawa cytatu itp.
300.000? Pewnie tyle, co jeden dzień na PB. Skala piractwa w necie miażdży wszytko. Inna sprawa, że tu nie chodzi o skalę, ale elementarną uczciwość.
I teraz pytanie – jeśli ktoś kupił taką płytę to jest "piratem"?
A może przy okazji jeszcze wspierał "pasernię", czyli dystrybutora/sklep z takimi płytami (takie określenie padało niedawno przy okazji serwisu odsiebie)?
IMHO nie jest, bo nabył utwór w dobrej wierze, nie mając podstaw do przypuszczenia, że utwór jest kradziony. Sytuacja może chyba być podciągnięta pod art. 169 par. 1 kodeksu cywilnego.
A propos: w tej chwili VaGla próbuje ustalić stan prawny ścieżek dźwiękowych wystawionych przez prezydenta i policję na ich stronach.
Ustalenie faktycznego stanu prawnego dystrybucji (tam też występują pośrednicy) to jedno, a ustalenie stanu prawnego pobierania (w tym wypadku nie kupna) to drugie, i tam np. też powstaje pytanie, czy – jeżeli w ramach produkcji lub dystrybucji nastąpiło naruszenie prawa – pobierający jest "piratem" (z którego przepisu), a jeśli nie, to czy na podstawie uznania dobrej wiary, czy dozwolonego użytku, czy może jakiegoś innego przepisu.
Idzie oczywiście nie o złośliwe paradoksy i czepialstwo, tylko o ważną rzecz: pewność prawa. Na razie w atmosferze "łapać złodzieja!" właściwie wszystko jest niepewne – nawet dokumentowanie na własną rękę.
Prawo autorskie nie przewiduje braku odpowiedzialności w przypadku braku świadomości łamania prawa autorskiego. Innymi słowy jeśli naruszone zostało prawo autorskie to jesteś winny nawet jak nie wiedziałeś, że jest naruszone.

No chyba, że istnieją jakieś wyjątki, np. przy założeniu, że odbiorca nigdy nie łamie prawa pobierając, nabywając, czy w jakikolwiek inny sposób zdobywając upublicznione utwory. Ale wówczas "piractwo" – rozumiane jako nieautoryzowane zdobywanie utworów innych niż programy komputerowe – byłoby tylko etykietą czysto moralną, a nie czymś zabronionym prawnie.

I oczywiście nawet prawo ścigające za jumanie utworów można sformułować tak, żeby uwzględniało przypadki zakupu płytki z wytwórni Sony zawierającej utwory, do których Sony nie miało praw, czy też nabycie Chipa z szemranymi dodatkami.
W tych konkretnych przypadkach użytkownik miał prawo oczekiwać, że wydawca zadba o odpowiednie prawa.
W przypadku ciągnięcia z rapidshare czy torrentów "dobra wiara" użytkownika jest już mocno wątpliwa.
Zgoda, ale mówisz tylko o prawie karnym – co do prawa cywilnego (odszkodowania, czyli "beknięcie" finansowe) to nie ma zgody. O ile zrozumiałem to VaGla stoi na stanowisku, że pobieranie utworów publicznie udostępnionych zawsze jest legalne, nieważne skąd się je zdobędzie (w szczególności nie ma znaczenia w jakiej wierze), natomiast są tacy, którzy uważają, że to zależy. Zdaje się, że trudno to na razie rozstrzygnąć, bo brak orzeczeń.
@kocio: kodeks cywilny ma art. 169, który mówi o kupowaniu kradzionych rzecz "w złej wierze". Niestety cały artykuł odnosi się do rzeczy ruchomych, a nie wiem, czy utwory pod takie coś podpadają czy nie. Równie dobrze może się okazać, że ta dobra wiara chroni tylko przed zakupem kradzionej płytki, ale już nie płytki z kradzioną muzyką
Bez jasnego orzeczenia sądu faktycznie trochę (przynajmniej dla takiego laika jak ja) niejasne.
Nie zdziwił bym się jakby pozwali tych co te płyty kupili.

Napisałem to w sensie ścisłym, tzn. nie są tożsame, ale różne interesy mogą się częściowo pokrywać. Stąd np. casus NiN, Radiohead, Coelho, Niny Paley itp. (przykłady gdy interes autora pokrywa się akurat z interesem odbiorców).
No nie wiem. Ja mimo wszystko jestem za tym zeby tak twarda reka wprowadzic dobra ustawe antypiracka ,zeby tak naprawde raz na zawsze skończyc z piractwem.
